Lent Money to a Friend who Won't Pay Back—Can He be Sued?

My bro (in MA) loaned his bf (in NJ) several grand last year, but hasn't been paid in full yet. Only received about 2 grand back. Has backup of voicemails, txts. He's been lied to and ignored, & he's getting sick of it all, and wants to take his friend to small claims court. How does it work if he lives in a diff. state? Does he even have a case?

    Save all e-mails and texts and print them as evidence. Check with your local small claims court. He has a case if there is an admission anywhere in his evidence.

    He can go to small claims court and the clerk will tell him if his claim is valid for that court. The friend would have to be served in another state. If that does not work, he can go to a lawyer and file his claim in a different court.

    To file in a small claims court, he may have to travel to his "friend's" town and file there. Again the court clerk can advise him.

    you can try to bring him to small claims court. Unless there was a contract stating that he had to pay the money back, his case will be harder to win. Contracts can be written or oral, but oral contracts become a he said versus he said type of thing and it's harder to prove. That's why you don't lend that much money to friends! Good luck

    Yes he can sue him because in is not in state laws, it is in federal laws and if you do have proof were both of them agreed to pay back and lend oney you have a good case.
