Can HR manager send employees home the day after Election Day due to them gleefully chanting president elect’s name who she didn’t vote for?

Keep in mind they were chanting in a respectful tone instead of obnoxiously and loud.  Therefore, is she (HR manager) being bitter and spiteful?

No chanting about anything at work.

Shut up and do your job or leave without pay.

    Final.

In general, politics do not belong in the workplace, at least not partisan politics. Regardless of how she voted, she might have sent the employees home because their behavior was inappropriate and disruptive. (Of course, office politics are another matter.)

They're sent home because they're disrupting business.

Yes, it would constitute a hostile work environment for those not gleefully happy that Biden won an election rigged in his favor.

    Yes.

Political chanting in the workplace is a no-no and is a violation of any basic workplace anti-harassment policy.

No, she isn't being bitter or spiteful.   She's doing her job which is to protect the company from liability.    It's her job to discipline/correct things that could cause potential legal issues and political chanting in the workplace is one of them.
